Judge holds off again on deciding whether West Virginia National Guard deployment to D.C. was lawful

A judge again held off on determining whether Gov. Patrick Morrisey is operating within his authority to deploy the West Virginia National Guard to patrol Washington, D.C.
Kanawha Circuit Judge Richard Lindsay heard about two hours of testimony Monday morning, but delayed making a final ruling until another hearing that he set for 2 p.m. Nov. 10. The judge already heard about an hour of testimony Oct. 24.

Clay County man killed in wreck near his home

CLAY, W.Va. — State Police have released the name of a Clay County man killed in a weekend car wreck. He’s identified as Charles Morris, 91, of Lizemores.
According to troopers Morris was a passenger in a vehicle travelling on Route 16 near Lizemores Saturday afternoon. The driver of his car went left of center and struck an oncoming vehicle head-on.

State revenue collections are ahead again for most recent month

West Virginia’s state government continues to bring in more tax dollars than anticipated.
October General Revenue Fund collections exceeded estimates by nearly $42 million, representing a 6% increase from the previous October, according to monthly numbers released today.
Cumulative year-to-date collections are also significantly above estimates and ahead of the prior year’s figures, a trend Gov. Patrick Morrisey attributed to growth in consumer spending and personal income.

Beckley police investigate suspicious vial found in Halloween basket

BECKLEY, W.Va. — Police are investigating a suspicious vial that was found in a trick-or-treat basket on Halloween night in Beckley.
Beckley police said the unknown substance was labeled as fentanyl.
“The item was promptly reported by a parent, and no injuries have been associated with the discovery. The substance will undergo laboratory analysis, and the investigation remains active and is being handled by our Detective Bureau,” a Monday news release said.

School Building Authority hearing proposals for annual “Needs” grants

CHARLESTON, W.Va. – The West Virginia School Building Authority will hear requests from more than 30 counties for grants under the state’s “Needs” program over the next two days, with proposals ranging from new roofs to expansion and large-scale renovations.

Trial rescheduled for man accused in Kanawha County convenience store shooting

CHARLESTON, W.Va. – A new trial date is scheduled for a man charged with first-degree murder in connection with a fatal shooting outside a Kanawha County convenience store.
Jacob Fields, 18, appeared before Kanawha County Circuit Judge Maryclaire Akers on Monday and, as a result of several factors, had his trial continued to January 26. Fields is accused of fatally shooting 42-year-old Tiffany Adkins as she walked into the Sheetz store in Kanawha City on May 28.

Elderly man killed in Clay County wreck

LIZEMORES, W.Va. — An elderly man is dead after a two-vehicle crash in Clay County.
State police said the crash happened Saturday afternoon on state Route 16 near Lizemores when two SUVs collided.
Troopers said a 91-year old man who was a passenger in one of the vehicles died in the crash. The driver of that vehicle along with the driver and a passenger in the other SUV were taken to CAMC, one of them by ambulance and two via HealthNet.
All three are in stable condition in the ICU at CAMC.
